The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
1.2. DefinitionsFor the purposes of these Terms and Conditions:
Account means a unique user, business, importer, or organizational account created or used to access the Service or any part of the official Customs declaration workflow made available through the Service, including submission, document upload, tracking, review, and related filing functions.
Authorized Service Provider means any third-party contractor, software developer, hosting provider, support provider, implementation partner, or other service provider authorized by the American Samoa Government Treasury and Customs Division to develop, host, maintain, secure, support, or assist in operating the Service.
ASG (referred to as either “the Company,” “We,” “Us,” or “Our” in this Agreement) refers to the American Samoa Government, Treasury Department, Customs Division, Pago Pago, AS 96799.
Content means any information, material, document, file, image, communication, declaration data, submission data, customs cargo details, commercial values, transportation conveyance details, quantities, written product descriptions, invoices, receipts, supporting records, attachments, or other information that can be submitted, uploaded, entered, posted, transmitted, stored, processed, or otherwise made available through the Service, regardless of form.
Country refers to: American Samoa, and United States.
Device means any device that can access the Service, such as a computer, cellphone, tablet, or other digital device.
Feedback means feedback, suggestions, recommendations, comments, or innovations sent by You regarding the attributes, performance, functionality, or features of the Service.
Service refers to the customs.as platform, Website, and related digital customs-service functions made available by the American Samoa Government Treasury and Customs Division, including public information pages, account access, declaration preparation, submission, document upload, status tracking, administrative review support, and other related workflow functions.
Submissionmeans any declaration, filing, document, attachment, supporting material, data entry, uploaded file, or other information transmitted, entered, uploaded, or provided through the Service as part of the Customs process.
Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the ASG regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
Website refers to customs.as, accessible from https://customs.as.
You means the individual accessing or using the Service, whether on that individual’s own behalf or on behalf of a company, importer, broker, consignee, employer, agency, or other legal entity, as applicable.
These Terms and Conditions govern Your access to and use of the Service and form the agreement between You and the ASG regarding Your use of the Service.
The Service is provided as part of a government-administered digital Customs service of the American Samoa Government Treasury and Customs Division. Your access to and use of the Service is conditioned upon Your acceptance of and compliance with these Terms and Conditions. These Terms apply to all visitors, users, account holders, guest users, importers, brokers, consignees, businesses, organizations, and other persons who access or use the Service.
By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You do not agree with any part of these Terms and Conditions, You may not access or use the Service.
You represent that You are over the age of 18 and have the legal capacity to enter into these Terms. The ASG does not permit persons under 18 years of age to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the ASG. The Privacy Policy describes Our policies and procedures regarding the collection, use, disclosure, and handling of information in connection with the Service. Please read the Privacy Policy carefully before using the Service.
Nothing in these Terms shall be interpreted to limit, replace, or override any applicable law, regulation, Customs requirement, government authority, administrative process, or official decision-making function of the American Samoa Government Treasury and Customs Division.
3.0. Pilot Initiative, Digital Learning, and Localization ResearchThe Service may be introduced, operated, expanded, or refined as part of a pilot initiative, phased rollout, digital modernization effort, or related public-service program of the American Samoa Government Treasury and Customs Division.
As part of this initiative, the Service may be used not only to support Customs filing and administrative processes, but also to support operational learning, community understanding, service improvement, workflow evaluation, localization research, and the ongoing development of digital Customs services designed for the realities of American Samoa.
This may include learning from how users interact with the Service, how declarations move through review, what kinds of filing support or guidance users need, where operational friction or confusion exists, how local workflows function in practice, and how digital tools may be improved to better reflect local laws, government procedures, inter-agency coordination, business practices, infrastructure realities, and other conditions relevant to the Territory.
You acknowledge and agree that information, communications, submissions, usage patterns, workflow activity, support requests, and related interactions connected with the Service may be used by the American Samoa Government Treasury and Customs Division, and by its Authorized Service Providers, for purposes connected with pilot administration, service evaluation, localization research, platform improvement, operational understanding, training, support, system refinement, and related government administrative purposes, subject to applicable law and policy.
Nothing in this section shall be interpreted to mean that every feature, workflow, process, or digital interaction made available through the Service is final, permanent, or fully complete. The Service may continue to evolve over time as Treasury and Customs assess operational needs, public use, legal requirements, technical performance, and opportunities for improvement.
4.0 User AccountsWhen You create an account with Us, You must provide information that is accurate, complete, current, and authorized for use at all times. Failure to do so may constitute a breach of these Terms and may result in the rejection of submissions, suspension or termination of account access, or other restrictions on use of the Service.
An account may be used to access functions related to theofficial Customs declaration workflow, including the preparation, submission, management, tracking, and review of declarations, documents, and related filing activity made available through the Service.
You are responsible for safeguarding the username, password, verification credentials, and any other security credentials used to access the Service, and for all activities, submissions, actions, and filings that occur under Your account.
During the current phase of the Service, shared company or organizational accounts may be permitted for operational use. Where an account is used by more than one person within a business or organization, the account holder and the business or organization on whose behalf the account is used remain fully responsible for all activity conducted through that account, including all declarations, submissions, uploads, statements, and related actions.
You agree not to disclose Your password or other access credentials to any unauthorized third party. Shared use within a business or organization is permitted only where such use is internally authorized, appropriately controlled, and consistent with these Terms and applicable Customs requirements. You must notify Us immediately upon becoming aware of any unauthorized access, security breach, misuse, loss of credentials, or suspected compromise involving Your account.
If You create or use an account on behalf of a business, importer, broker, consignee, employer, or other organization, You represent and warrant that You have the legal authority and operational authorization to act on behalf of that person or entity in connection with the Customs process and use of the Service.
You may not use as a username, account identifier, business identity, or profile name the name of another person or entity, or a name, trademark, or identifier that is not lawfully available for Your use, that is intended to mislead, impersonate, or deceive, or that is otherwise offensive, vulgar, fraudulent, or inappropriate in the context of a government-administered Customs service.
We reserve the right, but not the obligation, to review, verify, restrict, suspend, deactivate, or terminate any account, or to require additional information or documentation, where we determine, in our sole discretion, that such action is necessary for identity verification, account security, legal compliance, workflow integrity, fraud prevention, authorized-use validation, or protection of the Customs process.
Termination, suspension, or restriction of an account does not relieve You of any obligation arising from declarations, submissions, payments, reviews, investigations, or other activities initiated through or associated with that account.
5.0 Customs Declaration of EntryOur Service enables You to prepare, complete, submit, manage, and track Customs Declarations of Entry and related supporting documentation for inbound cargo shipments, mail and parcel post, and merchandise contained in passenger baggage entering American Samoa. This includes entries involving aircraft, ocean vessels, the United States Postal Service, and both accompanied and unaccompanied personal baggage.
The Service forms part of the official Customs declaration workflow of the American Samoa Government Treasury and Customs Division. Depending on the type of entry, the phase of the Service, and applicable Customs procedures, users may be able to create an account or proceed through certain filing steps as a guest, enter declaration information online, upload invoices and supporting documents, receive status updates, and complete one or more required submission steps through the Service.
Where enabled by the current Customs workflow, the Service may be used to submit declaration information and supporting documents as part of the official Customs process. Additional steps may still be required depending on the type of entry, applicable law, or current Customs procedures.
You understand and agree, however, that use of the Service does not by itself guarantee acceptance, approval, clearance, release of goods, or satisfaction of all legal or procedural requirements.Certain entries, goods, reviews, permits, inspections, payments, supporting documents, hard-copy requirements, in-person presentation requirements, or additional agency approvals may still be required depending on applicable law, regulation, policy, current Customs practice, or the nature of the goods being declared.
You are solely responsible for ensuring that all information, values, classifications, descriptions, supporting documents, exemption claims, and other materials provided through the Service are accurate, complete, current, lawfully submitted, and authorized for use. You are also responsible for completing any additional steps required by Customs or any other relevant government authority in connection with the declaration, review, inspection, release, or clearance process.
The Service may support certain classifications, calculations, workflows, exemption scenarios, and administrative processes; however, not all declaration situations, adjustments, exceptions, special approvals, or exemption types may be fully supported through the Service at all times. In such cases, You remain solely responsible for obtaining, preparing, presenting, and retaining any additional documents, approvals, explanations, calculations, or supporting materials required by Customs or any other relevant authority.
By using the Service, You represent and warrant that:
(i)You have the legal right and authority to submit, upload, process, and present the information and supporting documents associated with the declaration;
(ii)all information and materials provided by You are true, accurate, complete, and not misleading;
(iii)the preparation, submission, filing, and presentation of the declaration, together with the goods described therein, do not violate any applicable law, regulation, permit condition, trade restriction, ownership right, or Customs requirement; and
(iv)You are authorized to import, possess, control, consign, or otherwise act with proper authority in relation to the goods being declared.
By using the Service, You grant Us a non-exclusive right to receive, process, store, organize, review, and make available the information and documents You provide for purposes related to the Customs declaration process, including submission, administrative review, inter-agency coordination, legal compliance, recordkeeping, and operation of the Service.
You acknowledge and agree that information and documents submitted through the Service may be received, accessed, used, reviewed, transmitted within authorized government workflows, and retained by the American Samoa Government Treasury and Customs Division, and by other authorized government offices where required for Customs processing, inter-agency review, legal compliance, or related administrative purposes.
You retain all rights to Your submitted information and documents, subject to applicable law and the operational needs of the American Samoa Government Treasury and Customs Division.
5.2. Restrictions on Submitted InformationYou are responsible for all information, documents, and other materials submitted through guest access, account-based access, or any other permitted filing method made available through the Service. You agree not to submit any declaration, document, data, or other material that is false, misleading, inaccurate, unlawful, unauthorized, or intended to circumvent Customs laws, regulations, policies, reviews, duties, taxes, fees, or other official requirements.
Examples of prohibited or restricted submissions include, but are not limited to:
We reserve the right, but not the obligation, to review, flag, reject, suspend, remove, or restrict any declaration, document, data, account, or other material that we determine, in our sole discretion, may violate these Terms, applicable law, regulatory requirements, government policy, or the integrity of the Customs process. We may also suspend, limit, or terminate access to the Service where misuse, suspected fraud, unauthorized activity, or other prohibited conduct is detected.
Where appropriate, Customs may reject, hold, suspend, or refer any submission for further administrative, compliance, enforcement, or inter-agency review if the submission appears incomplete, inaccurate, unauthorized, unlawful, suspicious, or otherwise inconsistent with applicable law, regulation, policy, or official Customs requirements.
5.3. Declaration Data BackupsThe Service may perform routine backups, retention, archival, and recovery functions for submitted Customs Declarations, supporting documents, and related shipment data in order to support the operation, continuity, integrity, and administration of the Customs process.
While reasonable measures may be used to preserve and protect declaration data submitted through the Service, the ASG does not guarantee that any data, document, or submission will be preserved without loss, corruption, delay, inaccessibility, or system interruption.
Data integrity, retention, or recovery issues may arise from causes including, but not limited to:
We may make reasonable efforts to support, investigate, troubleshoot, or restore known or reported issues relating to declaration data, supporting documents, backup status, or restoration attempts. However, the ASG does not warrant or guarantee the accuracy, completeness, availability, recoverability, or successful restoration of any data, declaration, document, attachment, or system record stored in or processed through the Service.
Nothing in this section shall be interpreted as relieving any user of the responsibility to maintain independent, accurate, and complete records of declarations, invoices, receipts, approvals, supporting documents, and other materials relevant to the importation, review, clearance, payment, or release process.
You acknowledge and agree that backup, restoration, archival, and system-recovery functions are intended to support operational continuity and administrative recordkeeping, but do not replace Your responsibility to retain copies of all materials You submit or rely upon in connection with the Customs process.
6.0 Merchandise Classifications, Excise Taxes, Fees, and Importer-Based VariationsThe customs duties, excise taxes, and fees applied to imported goods in American Samoa are determined by two primary factors:
These variables affect how goods are taxed, what rates apply, whether any exemptions exist, and which fees are assessed by the American Samoa Government Treasury and Customs Division.
Users of this Service are responsible for accurately classifying goods and selecting the correct importer category to ensure correct tax and fee assessment.
6.1. Determining Charges Based on Classification and UseCustoms charges, including excise tax and Treasury fees, are not fixed. They vary based on:
Failure to properly declare the nature and use of goods may result in reclassification, additional taxes, penalties, or delays in clearance.
6.2. Classification of GoodsAll imported goods must be assigned a tariff code that reflects their correct classification according to American Samoa's annotated code. Common categories include:
Each item’s classification, and subclassification, will determine the applicable excise amount and tax formula.
6.3. Importer Categories and Intended UseCharges and exemptions may also depend on who is importing the goods and for what purpose. The same item may be taxed differently depending on the importer type.

Selecting the wrong importer category may result in incorrect tax calculation, delayed clearance, penalty/fine, confiscation of merchandise, or revocation of any tax exemption on file.
6.4. Excise Tax and Treasury Fee CalculationsBased on classification and importer type, taxes and fees may be calculated using:

6.5. Tax Exemptions and Special AuthorizationsThe Treasury Department may issue tax exemptions or preferential rates for certain importers or items. Exemptions may be:
Proper documentation must be provided at the time of declaration. Misuse of exemptions may result in audits, penalties, confiscation or delayed release of goods by ASG Customs.
6.6. Official Precedence and DisclaimerThe information, calculations, classifications, fee displays, and other assessment-related outputs made available through the Service are intended to support the Customs declaration process and may reflect current system logic, rate tables, workflow rules, and administrative configurations in use at the time of processing.
However, the Service does not eliminate the authority of the American Samoa Government Treasury and Customs Division to review, verify, correct, override, reclassify, reassess, or otherwise determine the proper classification, valuation, exemption status, duty, excise tax, fee, penalty, documentation requirement, or clearance condition applicable to any declaration, goods, or submission.
Accordingly, all final official determinations issued, applied, approved, or required by the American Samoa Government Treasury and Customs Division, whether through the Service, through manual review, through supervisory action, through inspection, or through any other authorized Customs process, shall control and prevail in the event of any inconsistency, dispute, discrepancy, omission, or system-generated error.
Users remain responsible for providing accurate, complete, and properly supported information and for complying with all applicable Customs requirements. Use of the Service does not guarantee that any system-generated classification, valuation, exemption treatment, duty calculation, excise tax calculation, fee calculation, or workflow status will be accepted as final without further review.
Where required, Customs may also rely on manual review, supporting documentation, inspection findings, inter-agency input, supervisory review, legal interpretation, policy guidance, or other authorized administrative action in making a final determination.
7.0 Intellectual Property Concerns and Improper Use of MaterialsThe ASG expects users of the Service to submit, upload, and use only materials that they are lawfully authorized to use in connection with the Customs process.
If You believe that any material made available through the Service has been submitted, uploaded, used, or made available without proper authorization, or otherwise violates intellectual property rights, proprietary rights, confidentiality obligations, or other legal rights, You may notify the ASG in writing at [email protected] and provide sufficient detail to identify the material and the basis for Your concern.
Upon receipt of such notice, the ASG may review the matter and may, where appropriate, restrict, remove, disable, or otherwise limit access to the challenged material, or take other administrative action consistent with applicable law, policy, and the integrity of the Customs process.
The ASG reserves the right to take such action as it deems appropriate in response to claims involving unauthorized use of materials, disputed ownership, misuse of documents, or other related concerns.
8.0 Intellectual PropertyThe Service, including its design, layout, structure, interface elements, software components, system architecture, business logic, workflows, functionality, text, graphics, logos, icons, and other original materials made available by the ASG or itsAuthorized Service Providers, is protected by applicable copyright, trademark, proprietary-rights, software, database, and other intellectual property and legal protections, to the extent applicable.
Except as otherwise permitted by law or expressly authorized in writing, You may not copy, reproduce, distribute, modify, republish, reverse engineer, create derivative works from, publicly display, or otherwise use any protected portion of the Service for unauthorized commercial or competitive purposes.
Nothing in these Terms transfers to You any ownership right, title, or interest in or to the Service itself, except for the limited right to access and use the Service in accordance with these Terms, applicable law, and applicable Customs requirements.
You may not remove, alter, obscure, or misuse any proprietary notice, attribution, identifier, logo, mark, or other source designation appearing in or through the Service.
This section does not apply to declarations, submissions, supporting documents, or other records provided by You through the Service, except to the extent otherwise stated in these Terms or required by applicable law.
9.0 Your Feedback to UsIf You provide feedback, suggestions, recommendations, comments, ideas, or other input relating to the Service, the Customs process, pilot initiative activities, localization needs, workflow improvements, user experience, or related government administrative functions, You agree that the ASG and its Authorized Service Providers may use, review, analyze, reproduce, adapt, modify, and incorporate such feedback for purposes of service improvement, operational learning, localization research, workflow refinement, training, support, platform development, and other government-related administrative or technical purposes, without restriction and without any obligation to compensate You.
You acknowledge and agree that any feedback You provide may be used to help improve the Service and related Customs processes, including during pilot activities, phased rollout, digital modernization efforts, and ongoing service refinement.
Nothing in this section transfers ownership of Your declarations, submissions, supporting documents, or other records You provide through the Service for Customs-processing purposes, except to the extent otherwise stated in these Terms or required by applicable law.
10.0 Links to Other WebsitesThe Service may contain links to, references to, or integrations with third-party websites, platforms, systems, data sources, service providers, carriers, or other external resources that are not owned, operated, or controlled by the ASG.
Such links, references, or integrations are provided for convenience, operational support, information access, workflow assistance, or related administrative purposes only. The ASG does not control and is not responsible for the content, availability, accuracy, privacy practices, security, reliability, or performance of any third-party website, platform, service, or external resource.
You acknowledge and agree that the ASG and its Authorized Service Providers shall not be liable, to the maximum extent permitted by applicable law, for any loss, damage, delay, error, omission, interruption, or other consequence arising from or related to Your access to, use of, reliance upon, or interaction with any third-party website, platform, service, or external resource.
Nothing in the Service shall be interpreted as an endorsement, certification, warranty, or guarantee by the ASG of any third-party website, service, provider, or external content unless expressly stated otherwise in writing.
You are responsible for reviewing the applicable terms, conditions, privacy notices, policies, and operational requirements of any third-party website, platform, or service that You access or use in connection with the Service.
11.0 Limitation of LiabilityTo the maximum extent permitted by applicable law, the ASG and itsAuthorized Service Providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the use of, inability to use, or reliance upon the Service, including, without limitation, damages for loss of profits, loss of business, loss of opportunity, loss of data, loss of records, delay, business interruption, personal injury, loss of privacy, or other intangible losses, even if the ASG or an Authorized Service Provider has been advised of the possibility of such damages. This limitation is intended to apply whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory.
Without limiting the foregoing, and to the maximum extent permitted by applicable law, the ASG and its Authorized Service Providers shall not be liable for any loss, damage, delay, cost, penalty, or consequence arising from or related to:
(i)errors, omissions, inaccuracies, or incomplete information provided by users;
(ii)system interruptions, downtime, technical faults, connectivity failures, software defects, infrastructure failures, third-party service interruptions, cybersecurity incidents, or data loss;
(iii)Customs holds, inspections, rejections, reclassifications, reassessments, delays, denials, seizures, penalties, or other official government actions taken in connection with any declaration, goods, or submission;
(iv)the acts, omissions, decisions, or delays of any importer, broker, carrier, freight forwarder, consignee, other government office, or other third party; or
(v)any user’s failure to comply with applicable law, regulation, permit requirement, policy, procedure, filing requirement, recordkeeping obligation, payment obligation, inspection requirement, or other Customs-related obligation.
Nothing in these Terms shall be interpreted to limit, waive, or exclude any liability that cannot lawfully be limited or excluded under applicable law.
In any case where liability is found to exist notwithstanding the limitations set forth above, the total aggregate liability of the ASG and its Authorized Service Providers arising out of or relating to the Service shall be limited to the greatest extent permitted by applicable law.
Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities. In such cases, the limitations in this section shall apply only to the extent enforceable under applicable law.
12.0 "AS IS" and "AS AVAILABLE" DisclaimerThe Service is provided on an “AS IS” and “AS AVAILABLE” basis, with all faults, defects, interruptions, limitations, and availability constraints that may exist from time to time.
To the maximum extent permitted by applicable law, the ASG and its Authorized Service Providers disclaim all warranties, representations, and guarantees of any kind, whether express, implied, statutory, or otherwise, with respect to the Service, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, performance, compatibility, or uninterrupted operation.
Without limiting the foregoing, the ASG does not warrant or represent that the Service:
(i)will always be available, uninterrupted, timely, secure, or error-free;
(ii)will always operate without delay, defect, omission, data loss, corruption, or technical failure;
(iii)will always reflect the most current legal, regulatory, administrative, operational, technical, or policy conditions at every moment in time;
(iv)will always be suitable for every filing scenario, entry type, exemption claim, review path, agency coordination need, or user-specific circumstance; or
(v)will always prevent, detect, or correct every inaccuracy, irregularity, misuse, fraud attempt, or unauthorized act.
The Service is intended to support the Customs process, but does not replace the user’s responsibility to provide accurate information, maintain required records, comply with applicable law and procedure, and complete any additional steps required by Customs or other authorized government offices.
The ASG further does not warrant that any information, classification, calculation, valuation, workflow status, document processing result, or system output generated or displayed through the Service will be final, error-free, complete, or accepted without further administrative, supervisory, manual, legal, or inter-agency review.
No oral or written information, guidance, assistance, support, training, communication, or technical help provided by the ASG or any Authorized Service Provider shall create any warranty, representation, or guarantee unless expressly stated in writing in an authorized agreement.
Nothing in this section shall be interpreted to limit any obligation, protection, or standard that cannot lawfully be disclaimed under applicable law. Where applicable law does not permit the exclusion of certain warranties or rights, this section shall apply only to the maximum extent enforceable.
13.0 Governing LawThe laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
14.0 Disputes ResolutionIf You have a concern, question, or dispute relating to the Service, You agree to first attempt to resolve the matter bycontacting the American Samoa Government Treasury and Customs Division through the contact methods made available through the Service.
You acknowledge and agree that the Service forms part of an official government-administered Customs process, and that certain matters arising from or related to declarations, submissions, classifications, valuations, exemptions, duties, taxes, fees, penalties, inspections, holds, releases, seizures, or other Customs determinations may be subject to applicable law, regulation, policy, administrative procedure, supervisory review, or other official government process.
Nothing in these Terms shall be interpreted to limit, replace, or override any governmental authority, administrative review process, legal requirement, enforcement action, or official Customs decision-making process that may apply under applicable law or policy.
To the extent a matter can be addressed through ordinary Service support, account assistance, filing guidance, or technical review, the parties shall make reasonable efforts to resolve the issue informally and in good faith before pursuing any further administrative or legal process.
15.0 For European Union (EU) UsersIf You access or use the Service from the European Union, You remain responsible for complying with any laws that apply to You in Your place of residence or use.
Nothing in these Terms shall be interpreted to limit any rights that cannot lawfully be limited under applicable law.
16.0 United States Legal ComplianceYou represent and warrant that Your access to and use of the Service, and any declaration, submission, document, goods description, or other information provided through the Service, shall comply with all applicable laws, regulations, sanctions, embargoes, restrictions, and prohibitions of the United States, American Samoa, and any other applicable jurisdiction.
You further represent and warrant that You are not:
(i)located in, organized in, or ordinarily resident in a country or territory that is subject to applicable United States embargoes or comprehensive sanctions to the extent such access or use would be prohibited by law; or
(ii)identified on any applicable United States government list of prohibited, restricted, blocked, sanctioned, or denied persons or parties, to the extent such status would lawfully restrict or prohibit Your use of the Service or participation in the Customs process.
Nothing in this section shall be interpreted to limit the authority of the American Samoa Government Treasury and Customs Division to review, restrict, reject, hold, suspend, or refer any account, submission, declaration, shipment, or user activity where necessary for legal compliance, sanctions screening, border protection, security review, or other authorized government purpose.
17.0 Severability and WaiverIf any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, consistent with applicable law and the original intent of the provision. If such interpretation or modification is not possible, the affected provision shall be deemed severed, and the remaining provisions of these Terms shall remain in full force and effect.
17.2. WaiverNo failure or delay by the ASG in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No waiver of any provision of these Terms shall be effective unless made expressly and in writing. Any waiver of a breach or default shall not constitute a waiver of any subsequent breach or default.
18.0 Translation InterpretationThese Terms and Conditions may have been translated from English if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
